recently, King's Daughters has sought CON approval under the substantative review process for additions to its Ashland campus, once for 120 beds and again for 50 beds.
Hospitals, nursing homes, ambulance services, doctors offices and others must obtain a permit under CON law before adding beds, services or equipment in many circumstances. The law is intended to prevent duplication of services, among other things.
A proposed change in state health care facility regulations could affect efforts to add extra beds at local hospitals.

The hospital documents that during each of the two (2) previous calendar years at least twenty (20) percent of its acute nonpsychiatric inpatient hospital admissions originated from counties not included in the hospital's area development district, as created and established pursuant to KRS 147A.050. While nonsubstantive reviews are based on the presumption of need, there would still be hearings on a CON application if requested by an affected party, he added.
It's an internal document, O'Donley said, which will require Cabinet and legislative review.
1. The letter of intent shall be filed no later than August 27, 2007, and the application shall be filed no later than September 26, 2007;
"Section 8. Nonsubstantive Review. (1) The cabinet may grant nonsubstantive review status to applications to change the location of a proposed health facility or to relocate a licensed health facility only if.
"KDMC's proposal does not meet an identified need in the area the proposal seeks to serve, as there are a number of area hospitals, including OLBH, with more than sufficient bed capacity to meet the needs of the defined geographic area," a February ruling stated.
The hospital continues to disagree with the state's findings, saying the need exists and that it's reached "functional capacity" in terms of available beds.
"To our knowledge, several hospitals could benefit from this change," he said, but added that the Cabinet didn't receive a specific request for the rules change.

Also, the regulation change states that a "letter of intent" to add the beds must be filed no later than Aug. 27, and a full application by Sept. 26.
In March, the Cabinet filed for a change in regulations, specifically to Chapter 900 of the Kentucky Administrative Regulations.
A state administrative law judge disapproved both requests, ruling that based on state criteria of overall area need, lack of interrelationships and linkages with other health care agencies, and economic feasibility.
If approved, the rule change is expected to impact all area hospitals' applications for adding acute care beds, including King's Daughters Medical Center, Our Lady of Bellefonte Hospital, Three Rivers Medical Center and St. Claire Regional Medical Center.
2. The application proposes to increase the hospital's existing licensed acute care bed inventory by no more than twenty (20) percent;
3. The hospital's acute non psychiatric inpatient occupancy rate was seventy (70) percent or greater (rounded up to the next whole number) according each of the two (2) most recently published versions of the Kentucky Annual Hospital Utilization and Services Report; and
O'Donley said the Cabinet must consider and address those comments, then it has an opportunity to amend before the change goes to a General Assembly administrative regulation review subcommittee. The changes then must be approved by the appropriate standing committee, likely the legislature's Health and Welfare.

"The intent was to only allow a hospital that qualified to only beneft from this status once," O'Donley said.

Under the change, facilities that meet certain requirements could qualify for "non substantive review" a less stringent part of the Cabinet for Air Max 98 Health and Family Services' certificate of need process.

The state's proposed addition to the CON rules, under Section 8 of 900 KAR 6:050 is:
"It gives the Cabinet flexibility to provide an expedited review process to certain types of applications, applications for hospitals proposing to add to their existing inventory," said Shane O'Donley, division director for the Division of Certificate of Need.
