"The issue is not going away," he said. "Twelve months is not sufficient."
Council also approved a contract with the Cincinnati based company Unifund to collect outstanding payments for drivers who have been cited by the red light cameras in the city. The city has red light cameras at the intersections of Windy Hill and Cobb Parkway, Allgood Road and Cobb Parkway, and Powder Springs Street and the North Loop.
"I think we as politicians or as community volunteers, we're never going to have complete harmony, but I think the public trusts you more and has more faith in you if they see the process is open," Tumlin said regarding moving all meetings to the council chamber and taping them. "And I think by opening the door to them, they see the process, they get to hear the debate why a decision is made one way or another."
In other business, council also put more teeth into Marietta's noise ordinance. In the past, if someone exceeds the maximum decibel level in Marietta, they are given notice Air Max 110 Reflective and must correct the problem. Once corrected, the slate is wiped clean and the process starts over. The revised ordinance will begin keeping track of offenses, with an escalated system of penalties over a 12 month period. The first and second noise violations will bring warnings from the city. The third violation would bring a $250 fine, the fourth comes with a minimum $500 fine, and the fifth and subsequent violations, $1,000 fines.
MARIETTA In a step toward the sunshine Wednesday, the City Council unanimously approved Mayor Steve Tumlin's efforts to conduct all meetings in the council chamber, as opposed to the cramped fourth floor conference room of City Hall, as well as record all meetings and post them on the city's website.
The matter stems from a conflict between certain industrial businesses along Marble Mill Road and nearby neighborhoods. In 2008, Coleman, representing the residents of Kennesaw Battle subdivision who complained about the noise and debris associated with a scrap yard off Marble Mill Road, confronted then Mayor Bill Dunaway. The scrap yard, Marietta Recycling Center, is owned by Steve Stewart, who bought the 4.6 acre tract for his company in 2006 from Dunaway. Dunaway also leases the front part of the property, 2.7 acres, to Marietta Recycling, which Stewart uses for office space.
Coleman vowed to bring the issue back.
Council also approved Tumlin's proposal to create a task force to study the height of buildings on the Square. The proposal is a result of Councilman Philip Goldstein's plan to bulldoze the two story Cuthbertson building on North Park Square and replace it with a five story, 22,000 square foot office building. Because the zoning ordinance for the Square is written to govern building height using comparable structures, Tumlin does not believe Goldstein can be stopped from his plan, since he can cite the Strand Theatre and the county courthouse as buildings of comparable size. The new task force would examine whether to revise the zoning ordinance to protect the two sides of the Square that have just two story buildings on them.

Council meetings are a four part process every month. First comes the round of seven committee meetings, composed of three council members each. In the past, staff had to track down the individuals who had not paid the outstanding tickets. Barrett said for fiscal year 2010, of the 20,197 citations for red light violations issued by the city, 5,256 remain outstanding. Unifund only gets paid if it collects on the outstanding funds. It receives 16.5 percent on collections that are two years old or less and 19 percent on collections that are older than two years, she said.
Councilman Van Pearlberg made the motion and council voted 4 3 with Anthony Coleman, Johnny Sinclair and Grif Chalfant voting against.
Shannon Barrett, assistant city manager, said the city has worked with the company in the last 18 months in a pilot program, and now is confident to extend them a one year contract with four, one year options to renew.
Coleman has pushed for stiffer penalties regarding noise violations, but said he voted against Wednesday's revised ordinance because he wanted to see a measure that would track violations for a period greater than just 12 months.
The council also created a committee to study the height of buildings on the Square, put more teeth into the city's noise ordinance and hired a firm to outsource the collection of delinquent red light tickets.

Each council member and the mayor will appoint two members to the task force, who will then elect a chair and vice chair. The task force will meet for a period of four months and present a recommendation to the council, Tumlin said.
